ANDE: Recommendations and Results
The Government of Ecuador has found the advice of the ANDE/CIPE program
to be extremely useful. The program has made recommendations in the first
three of its six priority areas, and most of these recommendations were
adopted by the Government of Ecuador as part of that nation's new Constitution.
Some of these "recommendations and results" are profiled below.
Administration of Justice
Recommendations:
- Eliminate the susceptibility of the judicial system to outside influences
- Install a commission of distinguished jurists to codify standards and
laws
- Amend subsidiary and procedural codes to eliminate double standards
being used by public officials
Results:
- Establish an independent seven-member committee, appointed by a majority
of deputies in the National Congress, that will codify and publish laws.
The committee will also compile and systematically organize Ecuador's 53,000
laws to eliminate duplication and contradictions and lessen the discretionary
authority of public officials.
Public Procurement and Contracting
Recommendations:
- Promulgate a new law to regulate contractual arrangements between the
public sector and private contractors
- Increase the powers of such regulatory bodies as the Office of the
Comptroller, the Attorney General, and the Inspector General of the Nation
Results:
- The National State Modernization Council (CONAM) has been assigned
to draft a new Public Contracting Law, and the power of regulatory institutions
will be increased.
Customs Process
Recommendations:
- Establish an Ecuadorian Customs Corporation
- Promulgate a new customs law in Ecuador
- Complete modernization of all customs operations in Ecuador
Results:
- Adopt a new customs law that will, among other things, govern the establishment
of an Ecuadorian Customs Corporation. The new corporation's members are
currently being selected.
